At issue in this case are five citation items issued by the Occupational Safety and Health Administration (“OSHA”) under the Occupational Safety and Health Act of 1970 (“Act” or “OSH Act”), 29 U.S.C. §§ 651-678, alleging that AKM LLC d/b/a Volks Constructors (“Volks”) violated certain recordkeeping requirements at its facility located in Prairieville, Louisiana. Having stipulated below to all relevant facts and the appropriateness of the proposed penalties, the parties filed cross-motions for summary judgment primarily addressing whether these recordkeeping violations were time-barred by the six-month limitations period in section 9(c) of the OSH Act, 29 U.S.C. § 658(c).1
